These Terms of Service ("Terms") govern your use of toygenie.com.au (the "Site") and any purchase you make through it. The Site is operated by TOY GENIE PTY LTD, ABN 84 684 293 089 ("ToyGenie", "we", "us", "our"). By accessing or using the Site, or by placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

### Eligibility
You must be at least 18 years old, or have the consent of a parent or legal guardian, to place an order on the Site.

### Products and Pricing
All prices are shown in Australian Dollars (AUD) and are inclusive of GST where applicable. We make reasonable efforts to display accurate product information, images and pricing, but errors may occasionally occur. If we discover a pricing or listing error after you've placed an order, we will contact you before proceeding and you may choose to cancel for a full refund.

We reserve the right to limit quantities, refuse an order, or discontinue a product at our discretion.

### Personalised Products and Your Content
Many of our products are created using photos, names, or other content you upload or provide ("Your Content"). By submitting Your Content, you confirm that:
- you own the rights to it, or have permission from the people shown in it (or their parent/guardian, if a child) to use it;
- it does not infringe any third party's rights, and is not illegal, offensive, or inappropriate; and
- you grant us permission to use Your Content solely to produce and fulfil your order.

We reserve the right to refuse to produce any order where Your Content appears to breach these Terms.

### Payment
We accept payment via the methods shown at checkout, which may include credit/debit card, PayPal, Afterpay, and Shop Pay. Payment is processed securely by our third-party payment providers; we do not store your full payment card details.

### Order Acceptance
Your order is an offer to purchase. We may accept or decline any order at our discretion, including in cases of suspected fraud, pricing errors, or stock unavailability. We'll notify you if we're unable to fulfil your order and issue a full refund.

### Intellectual Property
All content on the Site — including text, graphics, logos, and the ToyGenie name and branding — is owned by or licensed to us and protected by applicable intellectual property laws. You may not reproduce, distribute, or use our content without our prior written permission.

### Third-Party Tools and Services
The Site may use third-party apps and services (such as our AI shopping assistant, review and wishlist tools, and payment providers) to operate. We are not responsible for the availability or performance of third-party services outside our control.

### Limitation of Liability
To the maximum extent permitted by law, ToyGenie is not liable for any indirect, incidental, or consequential loss arising from your use of the Site or products purchased through it. Nothing in these Terms excludes or limits any consumer guarantee or right that cannot lawfully be excluded under the Australian Consumer Law.

### Changes to These Terms
We may update these Terms from time to time. Changes take effect once posted on this page, with the "Last updated" date revised accordingly. Continued use of the Site after changes are posted means you accept the updated Terms.

### Governing Law
These Terms are governed by the laws of Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Australia.
