These Terms of Service govern your use of www.toygenie.com.au and any purchase you make from us. By using this site or placing an order, you agree to these terms.

Who we are

This site is operated by Toy Genie Pty Ltd (ABN 84 684 293 089), trading as ToyGenie, of 10 Canny Court, Altona Meadows, VIC 3028, Australia.

Eligibility

You must be at least 18 years old, or placing an order with the involvement of a parent or guardian, to purchase from ToyGenie.

Personalised products and content you upload

Some products let you upload a photo or other content ("Your Content") so we can create a personalised item. By uploading Your Content, you:

confirm you own it or have the right to share it, and that you have the consent of anyone shown in it — including, where the subject is a child, the consent of that child's parent or legal guardian;
grant us a licence to use, reproduce, and process Your Content solely to create, fulfil, and support your order (including via the AI and print-on-demand tools described in our Privacy Policy);
agree not to upload content that is unlawful, offensive, or infringes anyone else's rights.

The finished personalised product is yours. We don't reuse your uploaded photos for any purpose beyond fulfilling and supporting your order, and we don't use them in our marketing without your separate, explicit permission.

Intellectual property

Except for Your Content, all content on this site — including text, graphics, logos, and the ToyGenie name — is owned by or licensed to us and may not be used without permission.

Pricing and payment

All prices are shown in Australian dollars (AUD) and include GST where applicable, unless stated otherwise. We reserve the right to correct pricing errors before an order is confirmed.

Orders and cancellation

We may cancel or refuse an order at our discretion — for example, if a personalisation request can't reasonably be fulfilled — and will refund you in full if we do. Once production has started on a personalised item, it generally can't be cancelled or changed; see our Refund Policy.

Consumer guarantees

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law, and, for New Zealand customers, the Consumer Guarantees Act 1993. Nothing in these Terms limits or excludes those rights.

Limitation of liability

To the maximum extent permitted by law, and subject to the consumer guarantees above, our liability for any claim relating to your order is limited to the amount you paid for the relevant product.

Governing law

These Terms are governed by the laws of Victoria, Australia. Disputes will be handled by the courts of Victoria, Australia, without limiting any statutory right you have to bring a claim elsewhere.
